OFFICIAL RULES

NO PURCHASE NECESSARY TO ENTER OR TO WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCE OF WINNING A PRIZE. Void in AK, AZ, CA, CO, HI, ID, LA, ME, MD, MT, ND, NV, NJ, NM, OK, OR, TX, UT, VT, VA, WA AND WY and where prohibited.

The BP “a little better game™” will consist of two parts, an In-Store Instant-Win Game (“In-Store Game”), and an Online Instant-Win and Online Collect and Win Game (“Online Game”). The In-Store Game and the Online Game are collectively referred to as the “Game” as described more fully in these Official Rules. The Game is subject to all federal, state, and local laws and regulations. The Game is sponsored by BP Products North America Inc. (“BP”), 28100 Torch Parkway, Warrenville, IL 60555 (“Sponsor”).

  1. ELIGIBILITY.

    Game is open to persons (“Participant”) who are 18 years of age or older at time of entry and who are legal residents of the following states: AL, AR, CT, D.C., DE, FL, GA, IL, IN, IA, KS, KY, MA, MI, MN, MO, MS, NC, NE, NH, NY, OH, PA, RI, SC, SD, TN, WV, and WI. Employees of BP, its parent company, jobbers, dealers, affiliates, subsidiaries, distributors, promotion or media partners, printer(s) of Game materials, Game material suppliers, and advertising, promotion, digital and other coordinating agencies involved in this Game, the officers and directors of each of the foregoing and members of the immediate families (defined for these purposes as including spouse, biological or step-parent, grandparent or step-grandparent, child or step-child, sibling or step-sibling and the spouses of each of the foregoing) regardless of where they live, or households (whether related or not) of any of the foregoing are NOT eligible to participate.

  2. HOW TO OBTAIN GAME CARDS.

    1. IN BP STATIONS.

      Starting February 3, 2010 through May 4, 2010, or when Official Game Card (“Game Card”) supplies are exhausted (“Game Card Collection Period”), whichever occurs first, with the purchase of a minimum of eight (8) gallons of any grade of BP gasoline with Invigorate® (“Qualifying Transaction”) at participating BP stations, you will receive one (1) Game Card from the cashier, upon request. If you paid for the Qualifying Transaction at the pump, present your receipt for Qualifying Transaction at time of purchase to the cashier to receive one (1) Game Card, upon request, while supplies last. LIMIT: One (1) Game Card per Qualifying Transaction per visit. For purposes of the Game (which includes a Game Code – defined below), a “visit” shall be defined as any visit to a participating BP station within the same two (2) hour period.

    2. WITHOUT PURCHASE BY MAIL.

      To request a Game Card (and a copy of the Official Rules) without purchase, send a legibly hand-printed, self-addressed, postage-stamped #10 envelope (“SASE”) with sufficient postage to: BP “a little better game™” Official Game Card Request, P.O. Box 1228, Elmhurst, IL, 60126-1228. DO NOT SEND ANY PRIZE CLAIMS OR OTHER CORRESPONDENCE TO THIS ADDRESS. One (1) free Game Card will be mailed in response to each mail-in request that complies with the requirements of these Official Rules, while Game Card supplies last. Mail-in requests, including both outer envelope and the SASE, must be handwritten and must be postmarked no sooner than January 20, 2010, and no later than May 4, 2010, and received no later than May 11, 2010. LIMIT: You may make as many Game Card requests as you wish by mail, but only one (1) request (yielding 1 Game Card) is allowed per postmarked outer mailing envelope. Requests that use address labels, are typed, computer-generated, photocopied, hand-stamped or have otherwise been mechanically or digitally reproduced, that are not mailed in separate outer postmarked mailing envelopes, or otherwise fail to comply with these Official Rules, will NOT be honored, acknowledged or returned and all such requests will forfeit any corresponding postage and unused envelopes.

  3. HOW TO PLAY THE IN-STORE GAME.

    Carefully scratch off the Game play area on the Game Card. If the word “WINNER!” and a prize description appear, you are a potential winner of the prize indicated, subject to verification and compliance with these Official Rules. If the words “Sorry, Card Not a Winner” appear, you are not a winner of a prize in the In-Store Game.

  4. HOW TO PLAY THE ONLINE GAME.

    Locate the Game Code (“Code”) found under the scratch off area on the Game Card. Sponsor will also be distributing a free Code via selected media. Visit www.alittlebettergame.com (“Website”) and enter your date of birth and state of residence beginning on February 3, 2010, at 12:00:01 a.m. CST (“Central Standard Time”) and ending on May 25, 2010, at 11:59:59 p.m. CDT (“Central Daylight Time”) (“Online Code Play Period”). Once Participants are verified as eligible to play, they will be required to register by completing the registration form as indicated. LIMIT: One (1) registration per person/email. Participants may not register with multiple email addresses nor may entrants use any other device or artifice to register multiple times or as multiple registrants. Any Participant who attempts to enter with multiple email addresses under multiple identities or uses any device or artifice to register/play multiple times will be disqualified and forfeits any and all prizes won, in Sponsor’s discretion. Registrants can play the Online Game during the Online Code Play Period using their email address and password established during registration. After completing the registration form, or by using email address and password, follow on-screen prompts to play the Online Game. Participants will have access to the BP virtual game board. Participants will be able to enter the Code to play the Online Game. When a Participant’s Code is received and recorded by the Sponsor’s website (“Online Game Play”), he/she will receive one (1) Online Game Play. Code may be used at any time during the Online Game Play Period for one (1) Game Play and can be used only one time per person/email address. LIMIT: Three (3) total Online Game Plays per person/email address/registration per day. For purposes of the Online Game, a “day” will be from 12:00:01 a.m. CT to 11:59:59 p.m. CT. Each Online Game Play will consist of an opportunity to move around the board for a chance to collect an Online Instant-Win Game Icon (defined below), an Online Collect and Win Icon or a Play Again Icon, as set forth in more details below:

    1. Online Collect and Win.

      During each Online Game Play, all of the icons (each an “Icon”) on the Online Game board will light up, one Icon at a time, until only one (1) Icon remains lit, which shall be deemed the Icon “collected” by the Participant for the Online Game Play. Upon collection of all of the Icons required for a particular winning combination (“Online Game Winning Combination”) (as set forth below), a message will appear that he/she is a potential winner of the Online Collect and Win Prize indicated, subject to verification of the Code , Online Game Play(s) and the Participant’s compliance with the Official Rules. The odds of winning an Online Collect and Win Prize are based upon obtaining each of the Icons stated in section 4(a) above to form the complete Winning Combination. For each Winning Combination there is one rare Icon which is randomly seeded one time during the Online Code Play Period with the other Icons being more common and randomly seeded throughout the Online Code Play Period. Ultimately, the odds of winning an Online Collect and Win Prize depends on the random times each rare and common Icon is seeded, the number of Game Plays and the time each Participant’s Game Play is received and recorded by the Sponsor.       Each Icon collected will be tracked and stored in the Participant’s “My Game Play”. “My Game Play” can be accessed anytime during the Online Game Code Play Period to view the Participant’s Game Play information, including the Icons collected.

    2. Online Instant Win.

      If, as a result of a Game Play, a Participant collects an “Instant Win” Icon, the Participant is a potential winner of an Online Instant Win Prize, subject to verification and compliance with these Official Rules. One winning time for the Online Instant Win Prize is randomly seeded for every hour of each day during the Online Code Play Period. The first Participant to execute a Game Play on or after a randomly designated winning time will receive a message indicating he/she is a potential winner of the Online Instant Win Prize, subject to verification and compliance with these Official Rules. The odds of winning an Online Instant Win Prize depend on the random times each Online Instant Win Prize is seeded, the number of Game Plays and the time each Participant’s Game Play is received and recorded by the Sponsor. LIMIT: three (3) Online Game Plays per person/email address per day of the Online Code Play Period. For purposes of the Online Game, a “day” will be from 12:00:01 a.m. CT to 11:59:59 p.m. CT.

    3. Play Again.

      If a Participant lands on one of the three (3) “Play Again” Icons the Participant may receive another Game Play by clicking on the “Play” button in the center of the virtual Online Game board. This additional Game Play will NOT count as part of the limit of three (3) total Game Plays per person/email address per day of the Online Code Play Period.

    The above stated Game information and In-Store Game odds are based on the total approximate number of Game Cards printed for distribution as of December 16, 2009. Total approximate number of Game Cards printed for distribution is 16,500,000. Total Approximate Retail Value (“ARV”) of all available Game Prizes is $683,425. LIMIT: One(1) prize per person/email address/address/household for winning prize combinations 1-4 and A (described above). LIMIT: Eight (8) prizes per person/email address/address/household for prize category B. BP “Gas for a Year” prize will be awarded in the form of BP Gift Cards with a total value of $2,250. BP “Gas for a Year” prize was calculated based on 16 gallons of gasoline purchased per week at $2.7043 per gallon over the duration of one year. Obviously, the price of gas fluctuates and no additional compensation will be given in the event of gas price fluctuation. The Gift Cards are subject to all terms and conditions imposed by BP.

  6. HOW TO REDEEM PRIZES.

    DO NOT SHOW OR GIVE ANY POTENTIAL WINNING OFFICIAL GAME CARD(S) FOR PRIZES TO ANY BP STATION EMPLOYEE. EMPLOYEES ARE NOT AUTHORIZED TO VERIFY OR FULFILL CLAIMS FOR ANY PRIZES.

    1. Redemption of Online Prize Categories 1-2.

      If a Participant receives an online message that he/she is a potential winner of a prize in categories 1-2, subject to verification, the Sponsor will attempt to contact such person by email or overnight courier within seventy-two (72) hours. Potential winners in prize categories 1-2, are required to sign and return an Affidavit of Eligibility and Liability/Publicity Release (where permitted) within fourteen days of the date these documents are mailed. Prizes won by an eligible entrant who is a minor in his/her state of residence will be awarded to minor’s parent or legal guardian who must sign and return all required documents. Failure to provide all required information and signature(s) on the Affidavit of Eligibility and Liability/Publicity Release may result in forfeiture of rights to be declared a prize winner and/or receive prize. Should this occur, the prize will not be awarded. Unless otherwise specified above, allow at least 4-6 weeks after verification for shipment of prizes. In the event there is a dispute as to the identity of an Online Winner, the Winning Online Game Play will be deemed made by the person listed in the registration form.

    2. Redemption of Online Prize Winning Combinations 3-4 and A.

      If Participant receives an online message that he/she is a potential winner of a prize in category 3-4 and A, subject to verification, Sponsor will ship the prize by mail or courier, without prior notification within 4-6 weeks following verification to the mailing address provided at the time of registration. In the event there is a dispute as to the identity of an Online Winner, the Winning Online Game Play will be deemed made by the person listed in the registration form.

    3. Redemption of the In-Store Game Prizes (Prize category B).

      You can redeem a potentially winning Game Card for Game prize category B either online or via mail. To redeem a potential winning Game Card for Game prize category B online, visit www.alittlebettergame.com, if you have not yet registered for the Online Game, register as set forth in Section 4 above. After registering and/or logging onto your account, follow on-screen prompts to enter the code found under the scratch off material on the Game Card to redeem your prize no later than 11:59:59 p.m. CDT on May 25, 2010, subject to verification. To redeem a potential winning Game Card for Game prize category B via mail, sign your full legal name across the original, official Game Card, in ink, and send the original Game Card in an envelope to BP “a little better game™” Redemption Center, P.O. Box 1083, Lombard, IL 60148-8083, along with your first name, last name, complete address (no P.O. Boxes), city, state, zip code, daytime and evening phone numbers and birth date hand-printed on a 3” X 5” piece of paper. Prize claims must be received no later than May 25, 2010. Do not enclose more than one (1) Game Card per postmarked outer envelope. If a postmarked outer envelope contains more than one (1) Game Card, all such prize claims will be disqualified, and the corresponding prize(s) will not be awarded. Winners of prize category B will be shipped their prize by mail or courier, without prior notification, within approximately 4-6 weeks after verification. Sponsor is not responsible for prize claims submitted/sent to the incorrect redemption address, undeliverable or garbled prize claims, claims submitted without sufficient postage, claims not received by Sponsor for any reason, including without limitation, human or technological errors or failures or prize claims submitted in a manner that is not allowed under these rules. All such claims shall be void and ineligible for a prize.
  7. OTHER CONDITIONS. Sponsor is not responsible for any changes of email address, mailing address and/or telephone number of Participants provided to Sponsor at the time of registration and/or prize claim. All prize claim submissions become the property of the Sponsor and will not be returned. Game Card, Codes, Online Game Plays and/or online prize messages are automatically void if counterfeited, mutilated, forged, fraudulent, altered, or tampered with in any way, if illegible, mechanically reproduced, obtained outside authorized legitimate channels or if they contain printing, production, typographical, mechanical, or other errors, or if they are rendered inoperable due to any type of malfunction or fraud, whether technological or otherwise. Sponsor is not responsible for lost, late, stolen, illegible, incomplete, damaged, mutilated, misdirected, or postage-due mail or fraudulent Game Card requests or prize claims. (See “Online Redemption” below in this Rule for further limitations on Sponsor’s responsibilities with respect to online prize claims). All Game Plays, Game Cards, Codes and prize claims are subject to verification by the independent judging organization, before any prize is awarded. Decisions of the judging organization are final, binding, and conclusive in all matters relating to this Game. ANY PERSON ATTEMPTING TO FORGE GAME MATERIALS OR TO DEFRAUD SPONSOR IN ANY WAY IN CONNECTION WITH THIS GAME WILL BE DISQUALIFIED AND MAY BE PROSECUTED TO THE FULLEST EXTENT OF THE LAW. Participant assumes all risk of loss or damage to, or destruction of, official Game Cards and/or Codes. Liability for official Game Cards and/or Codes containing printing or other errors or for official Game materials that are incomplete, missing, or rendered inoperable due to any type of malfunction, fraud or other error, is limited to replacement with one (1) Game Card and/or Code, while supplies last during the Online Game Code Play Period. No more than the intended number of prizes as outlined in these Official Rules will be awarded. If, for any reason, more valid prize claims are received than there are prizes at any level as listed in these Official Rules, the intended number of prizes at that level will be awarded through a random drawing from among all valid prize claims received for that prize level. All federal, state, and local income taxes on prizes and all other costs incurred in claiming, registering, or using any prizes, or expenses on receipt and use of prizes are the responsibility solely of the winners unless otherwise provided in these Official Rules. Winners will be issued an IRS 1099 form for prizes over $600. Actual prizes may vary in appearance from the prizes pictured. Prizes cannot be transferred or substituted except at Sponsor’s sole discretion, or as provided herein. Sponsor reserves the right to substitute a prize of equal or greater value if an advertised prize becomes or is unavailable for any reason. By accepting a prize, each winner (or his/her parent or legal guardian if winner is a minor as defined herein) consents to the use of winner’s name, hometown, likeness, voice, and/or biographical information for advertising and promotional purposes in commerce and in all media worldwide without limitation or additional notice or compensation, except where prohibited by law. All potential winners (or their parents or legal guardians, if applicable), by submission of prize claim, acknowledge compliance with these Official Rules and agree to release and hold harmless BP, its parent company, jobbers, dealers, affiliates, subsidiaries, distributors, promotion or media partners, printer(s) of Game materials, Game material suppliers and advertising, promotion, digital and other coordinating agencies involved in this Game, the officers and directors of each (“Promotional Parties”) from and against any and all liability for injuries or damages of any kind sustained in connection with participation in this Game or the use, acceptance, possession or awarding of any prize. In addition to the above, Promotional Parties are not responsible for (i) electronic transmissions or prize claims that are lost, late, stolen, incomplete, illegible, damaged, garbled, destroyed, misdirected, subject to fraud or not received by Sponsor or its agents for any reason, (ii) any problems or technical malfunctions, errors, omissions, interruptions, deletions, defects, fraud, delays in operation or transmission, communication failures or human error that may occur in the transmission, receipt or processing of the Game, Game Plays, Code submissions, prize claims, or for destruction of or unauthorized access to, or alteration thereof, (iii) failed or unavailable hardware, network, software or telephone transmissions, damage to participants’ or any person’s computer and/or its contents, or causes beyond Sponsor’s reasonable control that jeopardize the administration, security, fairness, integrity or proper conduct of this Game, or (iv) any prize claims submitted in a manner not expressly allowed under these rules; all such prize claims will be disqualified. All incomplete or non-conforming prize claims will be disqualified. Proof of submission of a claim does not constitute receipt of claim by Sponsor. The Promotional Parties do not assume any responsibility for any disruption in the Game caused by labor strikes, or any other act, circumstance or other unforeseen event outside of the control of the Promotional Parties. Entry material/data that have been tampered with or altered shall be deemed void. ANY ATTEMPT BY ANY PERSON TO DELIBERATELY DAMAGE THE WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE GAME MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK ALL REMEDIES AND DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW, INCLUDING CRIMINAL PROSECUTION. In the event there is a discrepancy or inconsistency between disclosures and other statements contained in any Game materials and the terms and conditions of these Official Rules, these Official Rules shall prevail, govern, and control. Should multiple users of the same email account participate in the Online Game and a dispute thereafter arises regarding the identity of the Participant, the authorized account holder of said email account at the time of entry will be considered the entrant. “Authorized account holder” is defined as the natural person who is assigned an email address by an Internet access provider, online service provider or other organization which is responsible for assigning email addresses or the domain associated with the submitted email address.
  8. WINNERS LIST. For a list of winners of prizes valued at $25 or more, mail a self-addressed, stamped #10 envelope to: BP “a little better game™” Winners List, P.O. Box 324, Lombard, IL 60148-0324. Requests must be received by May 25, 2010. Winners Lists will be sent when the Game is over and all properly claimed prizes are awarded.
  9. DISPUTES. By participating in this Game, Participant or his/her parent/legal guardian, as applicable agrees (a) that any and all disputes, claims, and causes of action arising out of or connected with the Game or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in Cook County, Illinois; (b) under no circumstances will entrant be permitted to obtain awards for, and participant hereby waives all rights to claim, punitive, incidental, consequential, or any other damages, other than for actual out-of-pocket costs incurred, excluding attorneys’ fees and court costs. All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, Participants’ rights and obligations, or the rights and obligations of the Sponsor in connection with the Game, shall be governed by, and construed in accordance with federal law and to the extent not inconsistent, the laws of the State of Illinois, without giving effect to any choice of law or conflict of law rules. By entering, entrants consent to the jurisdiction and venue of the federal, state and local courts for Cook County, Illinois.
  10. FORCE MAJEURE/APPROVAL AND UNFORSEEN OCCURRENCES.If, for any reason the Game cannot be conducted as planned, as determined by Sponsor or judges in their sole discretion, the Sponsor, may, without prior notice, terminate, modify or suspend the Game, in whole or in part. In the event of termination of the Game prior to the stated end date, Sponsor will post notice regarding the termination on the Game’s website (www.alittlebettergame.com) and will award only those prizes for which valid prize claims were received prior to the date/time of termination.
